Terms of Service

Welcome to GetFreeMenu. These Terms of Service ("Terms") govern your access to and use of the GetFreeMenu website, applications, APIs, and services (collectively, the "Service"). The Service is operated by Canny Edge Co., Ltd.(บริษัท แคนนี่เอดจ์ จำกัด), a company registered in Thailand ("GetFreeMenu", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

PLEASE READ SECTIONS 7 (THIRD-PARTY PAYMENT PROVIDERS), 13 (DISCLAIMER OF WARRANTIES), 14 (LIMITATION OF LIABILITY), 15 (SECURITY AND DATA INCIDENTS), AND 16 (INDEMNIFICATION) CAREFULLY. THEY LIMIT OUR LIABILITY TO YOU AND ALLOCATE RISK BETWEEN US.

1. Eligibility & Accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) and capable of forming a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, including the activity of any team members you invite. Notify us immediately of any unauthorized use. We may suspend or terminate any account that violates these Terms.

2. The Service

The Service lets restaurants and other food businesses create digital menus, generate QR codes, accept table-side and takeaway orders, operate a virtual queue (including GPS-gated reservations), run a kitchen display, manage a team, and view analytics and sales reports. The free plan provides the core digital-menu functionality at no charge. Specific features, limits, and availability may change at any time.

3. Plans, Billing & Subscriptions

The digital menu is free. We also offer an optional paid subscription ("Pro") that unlocks additional features such as white-labeling, higher limits, advanced analytics, and removal of advertisements from your public menu pages. By purchasing Pro you agree to the following:

  • Payments are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for Pro subscriptions. Paddle handles the sale, billing, invoicing, and the collection and remittance of any applicable VAT or sales tax. We do not receive or store your full card details. Your purchase is also subject to Paddle's Buyer Terms.
  • Subscriptions are billed in advance on a recurring basis (monthly or annually) and renew automatically until cancelled.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period and you retain Pro access until then.
  • You may request a full refund within 14 days of any payment for Pro. See our Refund Policy for how to request one.
  • We may change prices or plan features with reasonable prior notice; changes apply to subsequent billing periods.
  • Taxes, if any, are your responsibility unless we are required to collect them.

4. Advertising

The free Service is supported by advertising. We may display third-party advertisements (including via Google AdSense) on public menu pages and elsewhere within the Service. Advertisements are selected and served by third parties and are not endorsed by us; we are not responsible for the content, accuracy, or practices of any advertiser. Upgrading to Pro removes advertisements from your public menu pages. You agree not to interfere with, obscure, click-fraud, or attempt to circumvent advertising.

5. Your Content

You retain ownership of content you submit (menus, item names, descriptions, prices, allergen and dietary information, images, logos, translations, and similar). By submitting content you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display the content solely to operate and provide the Service, including making your public menu and ordering pages accessible to your customers. You represent and warrant that:

  • You own or have all rights necessary to submit the content.
  • The content does not infringe any third-party rights, including intellectual-property, publicity, and privacy rights.
  • The content—including all prices, descriptions, photographs, and allergen, ingredient, and dietary information—is accurate, lawful, and not misleading.

You are solely responsible for your content and for keeping it accurate and up to date.

6. Restaurant Responsibilities & Customer Transactions

The Service is a software tool. You—not GetFreeMenu—operate your restaurant and are solely responsible for your products, pricing, food safety, allergen and nutritional disclosures, tax, licensing, order fulfilment, and all dealings with your own customers.

Where the Service enables your customers to place orders, reserve a queue number, or pay you, any resulting payment or transaction is strictly between you and your customer. GetFreeMenu does not process, collect, hold, escrow, or guarantee those funds, is not a party to those transactions, and is not liable for any related dispute, chargeback, non-payment, fraud, refund, mispricing, or order error. You are responsible for verifying payments and for resolving disputes with your customers directly.

7. Third-Party Payment Providers

The Service lets you connect your own third-party payment provider or gateway (for example Toss Payments, KakaoPay, ZeroPay, GB Prime Pay, or Opn/Omise) so that your customers can pay you through the kiosk, takeaway queue, or other features. You connect each provider using credentials issued to you under your own account and contract with that provider.

For these connected providers, GetFreeMenu is not a payment processor, payment aggregator, payment facilitator, or merchant of record, and is not a party to any payment between you and your customer. Funds are authorized, captured, and settled by your provider directly to youraccount; we never receive, hold, escrow, or disburse your funds, and we never receive, process, or store your customers' card or bank-account numbers.

By entering a provider's credentials (such as API keys, client keys, secret keys, merchant IDs, tokens, or webhook secrets), you represent that you are authorized to do so and you authorize and instruct GetFreeMenu to store those credentials and use them to create, confirm, and query charges on your behalf for transactions initiated through the Service. Any charge or instruction created using your connected credentials is deemed authorized by you, whether or not it was initiated by you, a team member you invited, or the Service acting on your instruction. You may change or remove your credentials at any time, which will disable the corresponding payment feature.

You are solely responsiblefor: (a) complying with your provider's terms, developer agreement, and applicable rules (including any requirement to use a partner, sub-merchant, aggregator, account-chaining, or platform model), and for obtaining any approval your provider requires for third-party access; (b) keeping your credentials valid and your provider account in good standing; (c) all fees, refunds, chargebacks, reversals, disputes, receipts, invoicing, and taxes arising from your transactions; and (d) all of your legal, licensing, registration, consumer-protection, tax, and data-protection obligations in every jurisdiction where you operate. We do not provide legal, tax, or regulatory advice, and we make no representation that any payment integration is suitable for, or compliant in, your jurisdiction.

We provide payment integrations on an "as is" and "as available" basis and do not guarantee that any provider, charge, settlement, or webhook will be available, accurate, timely, or error-free. To the maximum extent permitted by law, GetFreeMenu is not liable for any loss arising from a connected payment provider, from the storage or use of your credentials, from a failed, duplicated, delayed, or incorrectly settled payment, or from any act or omission of your provider. Sections 14 (Limitation of Liability) and 16 (Indemnification) apply to your use of connected payment providers.

8. Acceptable Use

You agree not to use the Service to:

  • Upload unlawful, deceptive, hateful, obscene, infringing, or otherwise objectionable content.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems, or probe, scan, or test the vulnerability of any system without our prior written consent.
  • Introduce malware, scrape or harvest data, overload, or otherwise interfere with the normal operation, security, or integrity of the Service.
  • Use the Service for any fraudulent, harmful, or illegal purpose, or in violation of any third party's rights.

9. Intellectual Property

The Service, including its design, logos, brand, and underlying software (excluding your content), is owned by GetFreeMenu and protected by intellectual-property laws. You may not copy, modify, reverse engineer, or create derivative works of the Service without our prior written permission.

10. Third-Party Services

The Service integrates with or links to third-party services, including Paddle (payments and Merchant of Record for Pro subscriptions), any payment provider you connect to collect payments from your own customers (see Section 7), Amazon Web Services (hosting and storage), Google (OAuth sign-in, Analytics, AdSense, Ads, and Maps links), and IP-based geolocation and QR-generation providers. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the content, availability, or practices of any third-party service, and their availability is outside our control.

11. Service Availability & Changes

We provide the Service on an "as available" basis and may modify, suspend, limit, or discontinue all or part of the Service (including any feature, plan, or limit) at any time, with or without notice. We do not guarantee any level of uptime or that data will be retained indefinitely. You are responsible for keeping your own backups of important content.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or to protect the Service or other users. Upon termination, provisions that by their nature should survive will survive, including Sections 5, 6, 8, and 12–18.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR SECURE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, AVAILABLE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA WILL NOT BE LOST, ALTERED, OR ACCESSED WITHOUT AUTHORIZATION. YOU USE THE SERVICE AT YOUR OWN RISK.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETFREEMENU AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, BUSINESS, OR DATA, OR FOR ANY DAMAGES ARISING FROM SECURITY BREACHES, UNAUTHORIZED ACCESS, HACKING, MALWARE, SERVICE INTERRUPTION, OR LOSS OR CORRUPTION OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE LEGAL THEORY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

15. Security and Data Incidents

We use commercially reasonable technical and organizational measures to protect the Service. However, no system is completely secure, and we cannot and do not guarantee that the Service or your data will be safe from unauthorized access, hacking, breach, theft, or loss. You acknowledge and accept this risk. To the maximum extent permitted by law, GetFreeMenu shall not be liable for any unauthorized access to or alteration, disclosure, loss, or destruction of your content or any customer data transmitted through or stored on the Service, except to the extent directly caused by our gross negligence or willful misconduct and not excludable by law. You are responsible for securing your own credentials, devices, and team access, and for any notifications you are required to make to your own customers or regulators in the event of an incident affecting data you control.

16. Indemnification

You agree to defend, indemnify, and hold harmless GetFreeMenu and its owners, employees, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, your products and transactions with your customers, any third-party payment provider you connect and the credentials you supply for it, your handling of customer or payment data, or your violation of these Terms or of any law or third-party right.

17. Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. To the extent permitted by law, you agree that any dispute will be resolved on an individual basis and that you waive any right to participate in a class or representative action. Any disputes shall be brought exclusively in the courts of competent jurisdiction where the Service is operated, and you consent to that jurisdiction and venue.

18. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

19. General

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely. We are not liable for any delay or failure caused by events beyond our reasonable control (force majeure), including outages of third-party providers. These Terms are provided in English; any translation is for convenience only, and the English version controls in case of any conflict.
